General Terms and Conditions for potential Tenants with City-Residence GmbH

Commission-free brokering for tenants

The rental of apartments, rooms and houses brokered through City-Residence GmbH is always commission-free for tenants.

Proof of offering

As a contractor, City-Residence GmbH is hired to refer or broker rental properties that meet the given conditions. Proof or brokering can be provided by the contractor in any form, by phone call, fax or email to the potential tenants.

Duty of information

If the use of the agent results in a rental relationship, the broker must be informed immediately, the latest by the next business day.
This informational obligation applies even if no rental contract is concluded. The potential tenant shall simultaneously declare that he/she did not take advantage of the offers and will not take advantage of these in the future. The potential tenant, as the customer, shall be liable for any costs that City-Residence GmbH incurs due to non-compliance with this informational obligation.

Disclosure of data

The potential tenant’s data shall be treated confidentially by City-Residence, and shall only be shared with apartment providers or their representatives or agents in certain cases.
The potential tenant correspondingly agrees to treat any data received from City-Residence regarding accommodation providers (name, contact information, information about the employer, etc.) as confidential and not to share it with third parties.
Permission to request information from credit agencies
City-Residence usually obtains information about the potential tenant from credit agencies, like Schufa or Creditreform, when preparing the rental contract at the latest. The customer hereby agrees to this in advance.

Liability

The activities of City-Residence GmbH also extend to the brokering and referral activities. All further liability, particularly based on the existing accommodation situation or in the event that a rental confirmation is canceled, is expressly excluded.

Severability clause

The legal invalidity of individual provisions of this contract shall not affect the validity of the remaining provisions. In this case, the contract shall be interpreted correspondingly.

If the customer is an entrepreneur in the sense of the HGB [German Commercial Code], the place of jurisdiction is Frankfurt am Main.

Data protection

City-Residence GmbH takes the protection of personal data very seriously. We want you to know when we save what data and how we use it. As a private company, we are subject to the provisions of the Federal Data Protection Act (BDSG) and the Telemedia Act (TMG). We have taken technical and organizational measures to ensure that the rules on data protection are respected both by us and by external service providers.
